Software Usage Agreement

Please go through the complete license agreement before you purchase WeldPulse. If you don't agree to the terms and conditions written here, do not download the software. Using any edition of WeldPulse means that you agree to the terms and conditions mentioned herein. By using this software, you agree to be bound with this agreement. You further agree that any person you authorize to use WeldPulse will also be bound by the terms and conditions of this agreement. This PetroStreet End User license Agreement ("EULA") is a binding contract between the Licensee and PetroStreet when the Licensee is going to purchase the license of WeldPulse.

Definitions:
1. "PetroStreet" shall mean PetroStreet® Limited Company, its parent and affiliated corporations, its authorized distributors, and any third party which has licensed to PetroStreet any or all of the components of WeldPulse supplied to the Licensee
2. "Licensee" shall mean the individual, company, corporation, or other organization subject to this EULA due to their access or using of PetroStreet WeldPulse software
3. "WeldPulse" shall mean the software provided by PetroStreet which when used on Computer with Windows (XP or latest) as operating system provides assistance in taking decisions regarding welding. WeldPulse includes its design, upgrades, updates, installation files, images, working files, data, videos and other related documentation.
4. "Computer" shall mean a desktop, notebook, netbook or similar computer owned by and in the control of the Licensee
5. "Documentation" shall mean the associated files, data, videos concerning the software supplied by PetroStreet to the Licensee with the software
6. "Licensor" shall mean PetroStreet LLC, registered in FL, USA.
7. "Software" shall mean WeldPulse including following the application of any upgrade
8. "Upgrade" shall mean an upgrade, update, enhancement, improvement or patch to WeldPulse supplied by PetroStreet
9. "Source code" shall mean the code of the Software in which it is written
10. "Company" shall mean a registered company, incorporate or any other organization
11. "EULA" shall mean End User license Agreement

License:
1. PetroStreet grants the licensee non-exclusive, non-assignable, non-transferable license to use WeldPulse and documentation for your personal, limited purposes for a period of 15 days and in accordance with the terms and conditions following next.
2. PetroStreet does not allow the licensee to distribute, give or sub-license WeldPulse and documentation or to lease or rent, or to share WeldPulse and documentation in a manner restricting others to buy their own downloaded copy or in any manner not authorized here. The licensee may transfer all the licensee's rights to use WeldPulse to another person or legal entity provided that the transferee accepts and agrees to be bound by all the terms and conditions of EULA and the licensee destroy all copies of WeldPulse, including all copies stored in the memory of a hardware device, and provided the entirely of the licensed copy is transferred.
3. PetroStreet does not grant the licensee a license to the source code of the software. Licensee should only use the software as it looks like. Changes in its functioning, appearance, display or whatsoever making it different than original are not allowed to be made.
4. PetroStreet does not grant the licensee any rights to patents, copyrights, trademarks, trade secrets or any other rights otherwise mentioned.
5. One license is usable only for one computer. Each individual using WeldPulse should have his own copy of trial.
6. The licensee must not transfer the ownership of any computer on which WeldPulse is installed and licensed (fully working).
7. WeldPulse trial will automatically expire after 15 days with no further usage. Program will exit after running above 15 days.
8. Any decompiling, disassembly, reverse engineering or modification of WeldPulse is prohibited and illegal.
9. The licensee acknowledges and agrees that WeldPulse and documentation is an intellectual property and a trade secret of PetroStreet. You acknowledge that the software is owned in all respects by PetroStreet.
10. User must not be distributing the download link for WeldPulse
11. The licensee shall not re-produce, publish or transmit any image, video, code, data or other software contents in any form or by any means, without the prior written permission of PetroStreet.
12. When the trial expires, user, if wish to purchase must contact PetroStreet.
13. Upon termination of this agreement, the licensee must destroy all copies of WeldPulse under his control.
14. WeldPulse has been made by welding field specialists and carefully checked for errors and bugs however PetroStreet takes no guarantee or warranty, express or implied that WeldPulse provides accurate or validated results. WeldPulse results must only be applied by qualified personnel, familiar with welding and the subjects dealt by WeldPulse.
15. Once purchased through these terms and conditions, WeldPulse payment cannot be refunded.
16. This EULA is governed by the laws of the United Kingdom. For the purposes of the Sale of Goods Act 1979 & Supply of Goods and Services Act 1982 UK, WeldPulse is classified as computer software.
17. The licensee has the rights expressly set forth in the EULA and no other. All rights in and to WeldPulse, including unpublished rights, are reserved under the copyright laws. All rights reserved. This EULA may be enforced by PetroStreet or by an authorized dealer acting on behalf of PetroStreet.

Limitation of Liability:
Except as expressly provided otherwise in a separate written agreement between PetroStreet and the licensee, WeldPulse is provided "AS IS" without warranty of any kind, either expressed or implied. The licensee agrees that PetroStreet will not under any circumstances be held liable for damages or consequential loss that may for any reason be associated with the use of WeldPulse. Should an error be discovered and notified to PetroStreet, WeldPulse will be corrected.
